PURCHASE AGREEMENT -  PET QUALITY PUPPY

This contract is made this _____ day of_______________________, ______,  between Alice Caplinger, (Koda Rhodesian Ridgebacks), PARTY OF THE FIRST PART, and hereinafter named, “Seller”,  AND ______________________________________________________________, PARTY OF THE SECOND PART,  hereinafter termed, “Buyer”.

The purpose of this contract is for purchase of a pet quality Rhodesian Ridgeback puppy. The puppy in question is male/female, whelped on ____________, AKC Registration No.  _____________, microchip # __________________, and has the following color and markings, ________________________________.

This pet quality puppy is sold to Buyer for the price of $___________ (US$), and receipt of said monies is acknowledged herein by Seller.  Within fourteen (14) calendar days, Buyer may elect to return the subject puppy for any reason.  Koda Rhodesian Ridgebacks agrees to return the purchase price to Buyer in exchange for the subject puppy only if:

A.    The puppy is returned in the same state of health in which it was sold, and

B.     The puppy has not suffered any intervening injury, illness, or neglect.

Failure to satisfy either A or B above shall nullify any obligation of Alice Caplinger or Koda Rhodesian Ridgebacks to refund any or all of the purchase price.

You have selected one of the finest of the Rhodesian Ridgeback breed.  This puppy is a product of selective breeding by people dedicated to the improvement of the quality of the breed.  The Rhodesian Ridgeback is a dog of independent character, which takes its responsibilities of companionship, protection, and family dedication to heart.  He never forgets love and understanding nor does he lightly forgive harsh treatment.  He is a dog of noble bearing whose physical attributes reflect his role as a guardian, companion, and hunter.  These are the characteristics that make the Ridgeback such a useful and wonderful companion.

Koda is dedicated to perpetuating these outstanding qualities.  Like breeders before us, we strive to contribute to improvement of the breed.  Out of every litter, only a few puppies will prove to be worthy of breeding.  It is through the selective breeding of these animals that we maximize our chances of someday producing a really outstanding dog.  We have determined that this puppy is very likely not of breedable quality and should be neutered/spayed to prevent accidental breedings. 

STERILIZATION REQUIREMENT:

It is agreed by both parties that this puppy will be spayed or neutered at or around 12 months of age or later.  (See enclosed article on early spay/neuter).  This puppy will be issued a Limited Registration, meaning that the dog/bitch will be eligible to compete in AKC performance events, but will not be able to compete in conformation events, and none of its offspring will be eligible for AKC registration.  This puppy will not be bred at any time without written agreement between both parties.

HEALTH:

As can be reasonably determined by Alice Caplinger, (Koda Rhodesian Ridgebacks), through evaluation with at least two (2) other breeders/persons familiar with the Ridgeback standard and health at the time of execution of this agreement, the puppy referred to herein and the subject hereafter, is in good health and is free from any communicable diseases or dermoid sinus. 

At the time of purchase the pup has been examined by a qualified veterinarian for a general health screening, dewclaw removal, worming, and initial shots if recommended by said veterinarian.  As long as the puppy is not exposed to strange or risky dogs, its natural maternal immunities should give it adequate protection.  As always, please seek the advice of your veterinarian.  The puppy had has been evaluated regarding temperament and conformation.  Seller understands that this is a pet quality puppy and certain cosmetic flaws may exist which do not in any way affect the health or temperament of said puppy.  Seller is not responsible for problems that occur because of improper nutrition and care by another party.  The following defect(s) exist in said puppy, preventing it from being a show/breeding potential:  _____________________________________________

Buyer is required to have said puppy examined by a qualified veterinarian of his/her choice within three working days of receipt.  Any abnormalities or health problems identified will be disclosed to Seller at that time.

TRAINING:

In order to have a well-adjusted and happy pet, Seller strongly recommends obedience training for all puppies.   Buyer agrees to use positive reinforcement methods when training this puppy.  Buyer further agrees that harsh training methods will not be used with the subject puppy.

Buyer also agrees that Ridgebacks are “house” dogs and do not do well as backyard dogs.  Also, allowing any dog to ride unrestrained in the open bed of a pick-up truck is considered extremely dangerous and is prohibited by the terms of this contract.

Buyer agrees to enroll subject puppy in a puppy kindergarten class or socialization class appropriate to age as soon as possible – most certainly before 1 year of age.    In order to develop a good canine citizen, the Seller also encourages Buyer/Buyers to continue obedience training and/or performance training (agility, lure coursing, tracking, etc.) throughout the life of this puppy.

MISCELLANEOUS:

Buyer agrees that if the subject puppy, due to circumstance, must be relocated as a rescue, the Buyer is obligated to relinquish said dog to Alice Caplinger and Koda Rhodesian Ridgebacks unless further agreement is made between Buyer and Seller at that time.

Said puppy will not be resold to a third party unless agreement is made between Buyer and Alice Caplinger before such sale.    

Buyer(s) agrees to use the prefix “Koda” or “Koda’s” when assigning a registered name to this puppy.  Buyer(s) also agrees to inform Seller of all accomplishments and/or problems with said puppy.  Copies of health screenings will be forwarded to Seller in a timely manner.  Buyer(s) will inform Seller of address/phone number changes and agrees to keep in touch with Seller throughout the life of the subject puppy.

Seller agrees to be available whenever needed to help Buyer resolve any problems or concerns regarding this puppy.  Koda Rhodesian Ridgebacks accepts full responsibility for bringing this puppy into the world and will stand behind said puppy and support the Buyer throughout the life of said puppy. 

Buyer(s) agrees that he/she understands this contract fully and agrees to all conditions stated herein.  Buyer(s) also understands that this is the complete agreement and nothing oral or written outside of this document shall be part of this agreement, and that this contract is under the jurisdiction of El Paso County, State of Colorado, USA.

THIS IS A BINDING AND LEGAL CONTRACT BETWEEN ALL PARTIES INVOLVED.  ANY ATTEMPT TO BREAK THIS CONTRACT WILL BE CONSIDERED A “BREACH OF CONTRACT” AND IT WILL BE DETERMINED THAT THE BUYER/BUYERS CAUSING THE DAMAGES WILL PAY A SET AMOUNT OF $10,000.00 (US$) IN BREACH OF SAID CONTRACT, ALL ATTORNEY’S FEES AND COSTS INCURRED BY ALICE CAPLINGER dba KODA RHODESIAN RIDGEBACKS TO ENFORCE THIS CONTRACT SHALL BE THE RESPONSIBILITY OF BUYER/BUYERS.

This contract is entered into for the protection of the Rhodesian Ridgeback puppy identified herein, and Alice Caplinger, (Koda Rhodesian Ridgebacks).
